On September 12, 2000, Ms. Newman was traveling along Virginia 40, minding her own business, when a state police officer motioned for her to pull over. Had Ms. Newman been speeding? Was she weaving around after a night of cocktails? Was she a victim of racial profiling? No, she was pulled over for a routine “license and registration checkpoint.” Abby Newman knew her constitutional rights on that September evening better then those dumb police officers. Furthermore, she was willing to take a stand for those rights. Clearly, the search of her car was unreasonable; the cops had no warrant, nor did they have probable cause.

Why is it that hard to show your id? By law you HAVE TO if requested to do so by a law enforcement officers regardless if you think the stop is warrented or not if you are behind the wheel of a motor veheicle.Granted are all cops good and are they always right? No.Hell i've been stopped before for no reason but I still always show my ID when requested.But,I always ask why i'm being stopped too.

snoo23664, Thanks for the reference to the Virginia Code. Still, that law does not override the Fourth Amendment. The officer still needs at least specific and articulable reasons that criminal activity is afoot in order to stop her. Another poster said there was, but that is not evident in the video.In conclusion, it appears the officer behaved illegally.

According to the Code of Virginia Sect. 46.2-104 2nd paragraph states "The owner or operator of any vehicle, trailer, or semitrailer shall stop on the signal of any law-enforcement officer who is in uniform or shows his badge or other sign of authority and shall, ON THE OFFICER'S REQUEST, EXIBIT HIS REGISTRATION CARD, DRIVER'S LICENSE, LEARNER'S PERMIT, OR TEMPORARY DRIVER'S PERMIT and write his name in the presence of the officer, if so required, for the purpose of establishing his identity."
